- Presence of a duty of care or a duty to act – This is the responsibility that anyone has not to harm others and to make efforts to protect fellow participants in society. - Evidence that the duty of care was breached – Such as by driving drunk, ignoring speed limits, or otherwise failing to meet the duty of care.
- Actual and proximate cause – Proof that the negligent behavior is what caused the accident or incident in which the injury was sustained.
- Demonstration of real and measurable damages – Showing that the injury caused financial losses such as for medical costs, ruined property or lost wages, emotional anguish or even reputational damage.
