What We Do

Do I have a personal injury case?

Not all injuries qualify as personal injuries. A personal injury is any physical, emotional or financial injury, illness or other loss you sustain as a direct or indirect result of recklessness, carelessness, negligence or intentional wrongdoing. It is the circumstances of your injury—and specifically, the presence of negligence—even more than its severity that determines the strength of your case. Negligence is proven by meeting the following four criteria:

  • Presence of a duty of care or a duty to act – This is the responsibility that anyone has not to harm others and to make efforts to protect fellow participants in society. For example, motorists have a duty to drive safely, soberly and responsibly; manufacturers have a duty to create non-hazardous products, etc.
  • Evidence that the duty of care was breached – Such as by driving drunk, ignoring speed limits, or otherwise failing to meet the duty of care.
  • Actual and proximate cause – Proof that the negligent behavior is what caused the accident or incident in which the injury was sustained.
  • Demonstration of real and measurable damages – Showing that the injury caused financial losses such as for medical costs, ruined property or lost wages, emotional anguish or even reputational damage.
